1: General Terms & Conditions:
1:0 Duke’s Weddings will recover the cost of accommodation expenses and petrol where ceremony is at a distance of 100 miles or greater. Travel will be charged at 40p per mile.
1:1 It may be necessary to travel on the evening prior to the wedding to avoid traffic and other problems also it may be necessary to stay overnight where a wedding runs late. The cost of accommodation shall be reimbursed from the client with regards to late and distant weddings.
1:2 Food and beverages must be provided to all photographers where attendance is over 5 hrs.
1:3 Any additional charges incurred, will be recovered from applicant.
1:4 No additional travelling expenses will be incurred unless previously stated.
2: Booking Fee:
2:0 A 25% booking fee is required to confirm any booking of Duke’s Weddings services. The 25% booking fee covers any administration costs and secures the services of Duke’s Weddings wedding day photographic service. This booking fee is NON REFUNDABLE. Reservations are made on a strictly first come – first served basis. Dates will ONLY be secured upon receipt of the reservation fee.
3: Payment Terms:
3:0 Following payment of the 25% booking fee, balance of fees due are to be paid as follows: 50% is due 21 days prior to the wedding date & the remaining 25% balance is due following delivery of discs, albums or frames. No photographs, wedding albums or discs will be delivered until all payments due have been paid in full. Payment for additional images is to be made when they are ordered.
3:1 Any hours over the allotted 8 are to be charged at an hourly rate of £100.
4: Prices:
4:0 All prices quoted include VAT unless stated otherwise. Prices and specifications are subject to change.
5: Copyright:
5:0 The 1988 Copyright Design & Patents Act – section 77 & 80 assigns copyright of photographs/digital images to Duke’s Weddings. It is contrary to the act to copy or allow to be copied photographs/digital images captured by Duke’s Weddings by any means. Duke’s Weddings will always pursue breaches of this act in a court of law.
5:1 Images taken on your wedding day may be used for promotional purposes by Duke’s weddings.
6: Artistic Licence:
6:0 Duke’s Weddings shall be granted full artistic licence in relation to poses photographed and locations used at the wedding venue(s). Due to the vagaries of the weather and the willingness of subjects, it may not be possible to capture certain requested images. No one image shall be deemed ‘more important’ than any other image or be treated as such.
7: Digital files:
7:0 All digital files remain the property of Duke’s Weddings unless copyright has been purchased by the client for personal use only. On purchase of copyright Duke’s Weddings will release all high resolution files to the client ready to use on DVD/CD Rom discs along with copyright release information. The client shall be solely responsible for the discs safe keeping from that point onwards.
7:1 Any additional sets of discs requested shall be charged at £50 per set.
8: Albums & supplied prints:
8:0 Duke’s Weddings take the utmost care while producing albums and supplied prints. Our products are subject to rigorous quality inspections and are dispatched in perfect condition. On receiving our product(s) the client will have 7 working days to report any fault or problem due to shipping or handling to Duke’s Weddings. Duke’s Weddings will rectify any fault free of charge during this time period. Faults reported outside 7 working days will be subject to costs.
9: Cancellation of services:
9:0 The client may cancel their contract with Duke’s Weddings at any given time up to twelve weeks before the date of the wedding by sending written notice to Duke’s Weddings. Duke’s Weddings will reimburse any monies paid LESS the reservation fee which remains non refundable. Cancellation less than 12 weeks before the wedding date will result in the payment in full.
10: Force Majeure or Act of God:
10:0 The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
11: Attendance:
11:0 In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his / her best ability.
12: Limitation of Liability:
12:0 In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
